By purchasing through our Website, you confirm your acceptance of and agreement to be bound by the Terms & Conditions governing any Virtual Zone experiences described on the Website. Furthermore, by proceeding with your purchase, using our services and/or facilities, or participating in any activities at Virtual Zone’s premises, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. Hereafter, you will be referred to as the ‘User’ or ‘Users’.

Virtual Zone reserves the right to modify, update, or amend these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or business practices. When we do, we will make the revised terms available on our Website and we encourage you to review them periodically. Your continued use of our services or Website after any changes indicates your acceptance of the updated Terms. If you do not agree with any of the changes, we recommend not to proceed.

1. WHO WE ARE

Virtual Zone® is a Registered Trademark of Virtual Zone Nexus SL. Virtual Zone’s centres in the Republic of India are operated by Kalpana VR India Private Limited, a company duly incorporated under the Indian Companies Act (CIN U62099PN2025FTC244460), with its registered address at 2º Floor, Exoria Business Center, 4th Lane, Baner, Gaon, Haveli, 411045 - Pune, Maharashtra.

2. ORDERING PROCEDURE

2.1. Pricing: The prices of the Virtual Zone experiences shall be the prices displayed on the Website on the date of the User’s order. All payment for purchases made by customers for Centres located in India shall only be in Indian Rupees.

2.2. Booking: Booking an experience will require the User’s name and surname, phone number, email address, credit card details and any other ordering information specified on the Website. Users hereby accept and consent to the processing of its data for such purposes. Some experiences must be paid in full prior to the schedule date while others will require an advance booking fee.

2.2.1. Booking on behalf of another individual: If a User purchases a ticket on behalf of another individual, both the User and that individual agree that User is acting as the authorized agent of such individual, and accordingly, that person will be bound by these Terms and Conditions.
2.2.2. Booking on behalf of an individual under the age of 18 (hereinafter, a ‘Minor’): If a User purchases a ticket for a Minor, User represents and warrants that has the full authority to make such purchase on the Minor’s behalf either as his parent or legal guardian, or as an authorized agent acting on their behalf. User also agrees that both the User and the Minor shall be bound by these Terms and Conditions.

2.3. Order submission: By clicking ‘I Agree’, User accepts that a binding order has been placed and the Terms and Conditions shall apply. Users agree and accept that they are solely responsible for ensuring that the order details (i.e., date, time, number of players, VR experience booked, etc.) are accurate. The User acknowledges and accepts that the tickets are valid only for the date and time shown and are void if tampered with.

2.4. Order confirmation: Upon successful payment and clearance, a confirmation email will be sent to Users provided email address. If you do not receive a confirmation within two business days, please promptly contact our support centre at info@virtualzone.com. The order shall be deem completed only when this confirmation email has been issued. The User acknowledges and accepts that tickets cannot be transferred or resold.

2.5. On site: Upon arrival, Users that have paid a booking fee, shall pay the remaining amount. Failing to complete the payment of the outstanding amount on site will result in the User not being able to take part in the experience without entitlement to any refund or compensation for the advance booking fees. Users will be requested to register through our on-boarding platform. As part of our on-boarding process, Users will also be requested to sign the Waiver and Consent as a condition to take part in the VR experience.

3. OPERATING RULES

3.1. Virtual Zone offers these VR experiences for adults and for minors aged 12 and above with the explicit consent of their parents or legal guardian. Additionally, we recommend a minimum height of 4,6 ft / 1.40 meters for Users to ensure a safe and comfortable gameplay.

3.2. Users shall arrive at least to 20 minutes prior to commencing the experience to have enough time for a quick briefing, to get the equipment ready, and to enjoy the experience without feeling rushed. Therefore, punctuality is required to keep everything running smoothly so that can every User can enjoy the experience to the fullest.

3.3. Users arriving more than 10 will unfortunately lose their reservation without entitlement to any refund or compensation. The rest of the Users within a group that arrive on time will be able to enjoy the experience as booked.

3.4. Users must comply with all signs, notices, directions, instructions or requests by Virtual Zone’s staff. Failing to do so may result in the removal from the premises and/or suspension or termination of access to services, without entitlement to any refund or compensation.

4. USERS CONDUCT

4.1. Users shall not engage in any abusive, disruptive, or unlawful conduct while present at the centre. Furthermore, Users who are, or appear to be, under the influence of alcohol, intoxicating substances, or any impairing agents are prohibited from taking part in the experiences. Any violation of this provision may result in immediate removal from the premises and/or suspension or termination of access to services, without entitlement to any refund or compensation.

4.2. Users must not tamper with equipment or access restricted areas. Any violation of this provision may result in immediate removal from the premises and/or suspension or termination of access to services, without entitlement to any refund or compensation.

4.3. While Virtual Zone centres provide locker facilities for the convenience of its Users, it does not accept any responsibility or liability for the loss, theft, or damage of any personal belongings stored in these lockers nor damages to personal belongings caused during the experiences. Users acknowledge and agree that the use of lockers is at their own risk. It is the sole responsibility of Users to ensure the security of their valuables.

4.4. Users are required to use the Virtual Zone property responsibly, prioritizing their own safety as well as the safety of others. Should any injury to other individuals result from irresponsible, deliberate, or reckless conduct by a User, that User may be held liable. Additionally, User will be responsible for covering the cost of any damage caused to Virtual Zone’s property due to such conduct.

4.5. Virtual Zone reserves the right to refuse admission at its sole discretion. Entry to the VR centre is subject to approval by Virtual Zone’s staff, who will determine whether the User may be granted access.

5. HEALTH AND SAFETY NOTICE

5.1. Virtual reality experiences are generally considered safe activities. However, this does not eliminate the risk of accidents. Such incidents may result either from the physiological effects that using this technology can have on a person, or from potential missteps or sudden movements due to the high level of realism that these immersive experiences provide.

5.2. The use of Virtual Reality involves the perception of different stimuli that intensify the sensation of reality, which can cause anxiety due to greater interaction with the environment. It can also cause mild discomfort, such as dizziness or tiredness, and loss of balance in some people with intensive use. Users accept all risks associated with use of VR systems.

5.3. A comfortable virtual reality experience requires Users to have a normal sense of movement and balance. Users have to be able to move freely without assistance using their entire body. Do not use the VR glasses if you are feeling sick, tired, or sleep deprived; if you have consumed alcohol or drugs; if you have a hangover or digestive issues; if you are under emotional stress or anxiety; or if you have a cold, flu, headache, migraine, or ear pain. Using the VR glasses in these conditions may increase the chance of unpleasant symptoms.

5.4. Discontinue viewing immediately if you experience any of the following symptoms: seizures, loss of consciousness, eye strain or fatigue, eye or muscle twitching, involuntary movements, altered, blurred, or double vision, or other abnormalities, visual aces, dizziness, disorientation, balance disturbances, loss of hand-eye coordination, excessive sweating, increased salivation, nausea, malaise or headache or eye pain, drowsiness or other symptoms similar to dizziness.

5.5. For safety reasons, Users shall be free from any medical conditions which may affect them from safely participating. Conditions that preclude from safely participating include, but are not limited to, the following: (i) people with any degree of epilepsy or some type of brain dysfunction or neurological disorder, (ii) people that require the use of a wheelchair, (iii) people with heart conditions, (iv) deaf or severely hard of hearing, (v) highly sensitive persons, especially frightened or who suffers fearful situations before, (vi) If you have ever lost consciousness and/or (vii) pregnant.

5.6. Virtual Zone expressly disclaims any liability for the use of the devices by individuals experiencing the aforementioned conditions or any other circumstances that would contraindicate the use of this technology. In case of doubt, please seek medical advice prior to booking or taking part in the experience.

6. ASSUMPTION OF RISKS AND LIABILITY WAIVER

6.1. Acknowledgment of Risks: The User hereby acknowledges that they have been fully informed of the inherent risks associated with participation in VR activities at the centre. These risks include, but are not limited to, motion sickness, dizziness, disorientation, eye strain, nausea, falls, or other physical or psychological effects.

6.2. Assumption of Risk: The User voluntarily assumes all risks, known or unknown, arising from or related to their participation in VR activities at the centre, including any risks arising from equipment malfunction, staff instructions, or interactions with other users.

6.3. Waiver and Release of Liability: To the fullest extent permitted under Indian law, the User hereby waives, releases, and discharges Virtual Zone and/or its or its licensors, its owners, employees, agents, and affiliates from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or in connection with the User’s participation in VR activities. This waiver includes, without limitation, any claims for personal injury, or property damage whether caused by negligence or otherwise, except where such liability is expressly mandated by law and cannot be waived.

6.4. Indemnification: The User agrees to indemnify, defend, and hold harmless the Virtual Zone and/or its or its licensors and its affiliates from any claims, damages, costs, or expenses (including reasonable legal fees) arising out of or related to the User’s conduct, negligence, or violation of these Terms and Conditions.

6.5. Legal Capacity: The User confirms that they are of legal age, mentally competent, and legally able to enter into this waiver. If the User is under the age of 18, a parent or legal guardian must sign on their behalf and assume the obligations hereunder.

7. PRICING & PAYMENT TERMS

7.1. All prices for Virtual Zone products and services are as stated on the Website and are quoted in Indian rupees. Virtual Zone reserves the right to modify prices at any time without prior notice.

7.2. Virtual Zone does not accept responsibility for any errors in pricing or information supplied by third-party payment processors beyond its reasonable control.

7.3. Users are responsible for ensuring the accuracy of all information provided during the payment process, including payment details and billing information.

7.4. Full payment for all purchases must be made prior to enjoying the experiences (see Clause 2.5) using the accepted payment methods provided. No access to the experiences will be granted until full payment has been successfully processed and cleared prior to the commencement of the experience.

7.5. Accepted payment methods include debit and credit cards, Unified Payments Interface (UPI) such as Google Pay, PhonePe, and Paytm, QR code payments and net banking (only for the booking fees). Cash payments are not allowed.

7.6. No transmission of data over the Internet can be guaranteed to be completely secure. While Virtual Zone endeavours to protect any information you provide, it does not warrant or guarantee the security of any transmitted information. Accordingly, any information you transmit to Virtual Zone or its third-party payment providers, including credit card details, is done at your own risk. To the fullest extent permitted by law, Virtual Zone shall not be liable for any financial loss or consequential damages arising from or related to your use of the Website, whether due to negligence, breach of contract, statutory duty, or otherwise.

8. RETURN AND CANCELLATION POLICY

8.1. If User makes a reservation at Virtual Zone and pays for the session, User can change or cancel your booking by sending us an email up to 48 hours before your scheduled time. We will do our best to accommodate your new preferred date and time based on availability. To cancel, email us with the subject “Cancel Reservation” to info@virtualzone.com and include your reservation details. We will refund your payment, and you will get your money back within 15 days.

8.2. Rescheduling requests or cancellations made less than 48 hours before the session will not be accepted. No refunds or reschedules can be made after this 48-hour window. This policy helps us manage bookings efficiently and provide the best experience for all customers.

8.3. Other circumstances that do not entitle Users to any refund or compensation are set out in this document and include, among others: (i) Users that fail to make the full payment prior to the experience at the scheduled date (Clause 2.5), (ii) Users arriving more than 10 minutes late (Clause 3.3), (iii) Users failing to comply with all signs, notices, directions, instructions or requests by Virtual Zone’s staff (Clause 3.4), (iv) Users who are, or appear to be, under the influence of alcohol, intoxicating substances, or any impairing agents (Clause 4.1) and (v) Users that tamper with equipment or access restricted areas (Clause 4.2).

9. WEBSITE TERMS OF USE

9.1. All content on this Website, including but not limited to text, graphics, logos, images, audio, and software (“Website Content”), is the exclusive property of Virtual Zone or its licensors and is protected under Indian copyright and trademark laws. You may not copy, modify, distribute, or use any Website Content without prior written permission from Virtual Zone.

9.2. This Website may contain links to third-party Websites. Virtual Zone does not endorse or assume responsibility for the content or practices of these external sites nor is responsible for the privacy policies or the contents of other web pages.

9.3. The Website uses cookies and collects certain information. By using the Website, you consent to such practices.

10. COLLECTION AND USE OF PERSONAL INFORMATION AND IMAGES:

10.1. Virtual Zone collects and processes personal information including but not limited to names, contact details, payment details and session activity data solely for the purposes of providing and promoting services, ensuring security, and complying with legal obligations. Personal data shall be handled in accordance with the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (DPDP Act), and other applicable privacy laws.

10.2. For the safety and security of Users, staff, and property, Virtual Zone premises are monitored by a Closed-Circuit Television (CCTV) system. CCTV recordings may capture images and video of users while on the premises. These recordings are used strictly for security monitoring, incident investigation, and compliance with applicable laws. By using the centre’s services, users consent to such monitoring.

10.3. Photographs or video recordings of Users taken by the centre for promotional, safety, or operational purposes will only be used with explicit prior consent, except for CCTV footage which is used solely for security and operational purposes and retained as per legal requirements.

10.4. In case of videos and images for promotional purposes and upon the User’s consent, User agrees to the free publication and/or use in any form or media whatsoever of such images and videos, without payment or compensation of any kind.

10.5. Subject to legal limitations and reasonable operational requirements, Users have the right to access, correct, or request deletion of their personal information held by Virtual Zone by sending an email to info@virtualzone.com with the subject "Data Protection Exercise.

11. SEPARABILITY AND SEVERABILITY

11.1. If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court or competent authority, such provision shall be severed from the Agreement and shall not affect the validity, legality, or enforceability of the remaining provisions. The remaining provisions shall continue in full force and effect as if the severed provision had never been included.

12. GOVERNING LAW AND JURISDICTION

12.1. Any disputes arising out of or in connection with the Terms and Condition and/or the use of Virtual Zone services or its licensors shall be governed by and construed in accordance with the laws of India.

12.2. The parties hereby irrevocably submit to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India for the resolution of any disputes, claims, or proceedings arising out of or relating to these terms or the services provided.
