Legal Terms and Operating Rules

2. Purpose and acceptance

These Legal Terms govern access to and use of the website www.virtualzonevr.com, as well as the booking of the virtual reality experiences offered by VZ and the operating and safety rules applicable at its centers.

Making a booking or accessing the experiences implies full acceptance of these Legal Terms, the Privacy Policy and the Cookie Policy. If the user does not agree with their content, they must refrain from using the website and from booking the services.

Scope. These terms apply to the services provided by Virtual Zone Nexus, S.L. at its centers in Spain, at the center in The Hague (Netherlands) and at the center in Pune (India). The centers operated in France (Paris, Bordeaux and Lyon) are run by Virtual Zone Francia, an affiliated and independent company, and are not governed by these terms.

3. Intellectual and industrial property

All content on the website (text, images, audio, video, graphic design and source code), as well as trademarks and distinctive signs, belong to Virtual Zone Nexus, S.L. or to third parties who have authorized their use, and are protected under intellectual and industrial property law.

Users are authorized to view and make private copies of the content exclusively for personal, non-commercial use. Distribution, modification, public communication, transformation, or any other use not expressly authorized by the rights holder is prohibited.

4. Terms of use of the website

Users agree to make appropriate and lawful use of the website and not to use it for unlawful activities, activities that infringe third-party rights, or that could damage, overload, or prevent the normal operation of the site.

VZ does not guarantee uninterrupted availability of the website, although it will take reasonable measures to prevent interruptions. VZ is not responsible for damages arising from misuse of the site by the user, nor for information hosted on linked third-party sites (see section 15).

5. Booking and contracting process

Users may book VZ experiences through the website, in person at the centers, or by phone. During the booking process, the user selects the center, the experience, the number of participants, and the desired date and time, and proceeds to payment to confirm the booking.

It is the user’s responsibility to provide truthful and complete information. Bookings may only be made by a person over 18 years of age, who will be responsible for the booking and, where applicable, for any minors participating in the group.

6. Prices and payment methods

Experience prices are those shown on the website at the time of booking, in euros, taxes included. The final applicable price is shown in the shopping cart before confirming the booking.

Available payment methods are:

  • In Spain: bank card and Bizum, via the Redsys payment gateway (connected to Banco Santander), as well as PayPal. Cash payment is also available at the centers.
  • At the Pune (India) center: via the CashFree payment provider.

VZ does not store bank card data: payment is processed directly through the corresponding payment gateway.

7. Cancellation and refund policy

Users may request modification or cancellation of their booking by email to info@virtualzone.es with the subject “Cancel booking”, up to 48 hours before the booked date and time. In such cases, the amount paid will be refunded within a maximum of 15 days.

Cancellations or modifications requested less than 48 hours in advance are not eligible for a refund. Once a session has started, no refunds will be made.

Delays. Users are advised to arrive 15 minutes before the booked time. If a user is more than 10 minutes late for their booked time, they may lose their booking with no right to a refund, since each session has a limited duration and requires a prior safety briefing. Other participants in the group who arrive on time may still take part in the experience.

8. Access, age, and safety rules

8.1. Minimum age

The recommended minimum age for access to the experiences is 8 years old for cultural experiences and 10 years old for gaming experiences. Minors must in all cases have the express authorization of their parent or legal guardian and participate under their responsibility, by signing the corresponding authorization form.

Minors must be accompanied by a responsible adult, who must remain on the premises during the experience.

8.2. Minimum height

For safety reasons and the correct operation of the virtual reality equipment, a minimum height of 1.20 meters is required to take part in the experiences.

8.3. Health and safety conditions

Virtual reality experiences involve intense visual and motion stimuli, as well as physical movement around the play area. As such, they may not be advisable for people with certain conditions, such as pregnancy, epilepsy or other neurological disorders, heart conditions or blood pressure issues, previous episodes of loss of consciousness, or severe hearing or balance problems.

Virtual Zone informs users of these circumstances so that each person — or, in the case of minors, their parent or legal guardian — can freely assess their participation and, in case of doubt, consult a medical professional beforehand. The decision to participate rests with the user, who makes it voluntarily once informed. These recommendations do not replace medical advice.

8.4. Accessibility

Virtual Zone’s facilities are accessible to people with reduced mobility and wheelchair users. Virtual Zone does not exclude participation on the grounds of disability. If a participant would like information on the suitability of a specific experience for their circumstances, they can consult Virtual Zone staff beforehand. People with vision in only one eye may also take part in the experiences.

8.5. Right of admission

Virtual Zone reserves the right of admission. Virtual Zone staff may, on justified grounds, deny access to the play area for safety reasons, for example when a person is or appears to be under the influence of alcohol or drugs.

9. Rules on the use of equipment and facilities

Running and jumping are prohibited during the experience, as is bringing outside food or drink. Removing the equipment during the experience is not permitted except in an emergency; in such a case, the user must lift the headset onto their forehead and ask staff for help.

The virtual reality equipment is high-cost electronic equipment that requires careful use. Irresponsible use is considered to be any use that damages or deteriorates the equipment beyond normal wear (for example, handling it with dirty hands or spilling liquids on the premises).

Liability for damages. VZ may claim from the user the costs of repair or replacement when damage to equipment or facilities results from improper, negligent use or use contrary to the operating rules by the user. This liability is limited to damage actually caused by such improper use.

10. Recommendations for using virtual reality

The use of virtual reality can cause mild discomfort in some people, such as dizziness, eye strain, disorientation, or loss of balance. We recommend:

  • Consulting a doctor before using the equipment in cases of pregnancy, advanced age, relevant medical conditions, psychiatric disorders, or implanted medical devices (for example, pacemakers). These recommendations do not replace medical advice.
  • Not using the equipment when tired, sleep-deprived, stressed, or under the influence of alcohol or drugs.
  • Stopping the experience and notifying staff if dizziness, nausea, altered vision or other symptoms occur, by lifting the headset and asking for help.
  • Taking breaks after the experience to reduce potential discomfort.

11. Audiovisual recording

During the experience, Virtual Zone may capture images and video of participants to monitor the activity and ensure their safety, as well as to prepare a memory video that will be sent to the adult responsible for the booking.

Virtual Zone may use images or videos of adult participants for commercial or promotional purposes only when the participant has given express, specific, and differentiated consent for that purpose, revocable at any time. Virtual Zone does not use images or videos featuring minors for commercial purposes.

The processing of these images is governed by the Privacy Policy.

12. Limitation of liability

VZ has fitted out its facilities to minimize risks (for example, with padded floors and walls). Users are informed that the images they view are virtual and not real, so they must not attempt to lean on virtual objects or make sudden movements.

Users who take part in the experience are informed of its inherent risks and voluntarily assume them. However, this assumption of risk does not exempt VZ from liability for damage caused by its own fault or negligence, defects in the equipment or facilities, or failure to comply with its safety and information duties.

13. Data protection

The processing of users’ personal data is governed by the Privacy Policy and the Cookie Policy, in compliance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

14. Transaction security

Payment transactions made through the website take place in secure environments managed by the corresponding payment gateways (Redsys, connected to Banco Santander, and PayPal), which apply encryption protocols to protect transaction data. VZ does not have access to users’ full bank card details.

The website may contain links to third-party pages. VZ is not responsible for the content or privacy policies of such sites, which are provided for informational purposes only. The inclusion of a link does not imply any relationship, endorsement, or supervision by VZ.

16. Applicable law and dispute resolution

These Legal Terms are governed by Spanish law. In the event of a dispute, where the user is a consumer, the courts and tribunals corresponding to the consumer’s domicile shall have jurisdiction, in accordance with consumer protection regulations.

Likewise, in accordance with European regulations, the consumer may access the European Commission’s Online Dispute Resolution platform.

17. Modification of these terms

VZ may modify these Legal Terms to adapt them to legislative or case-law developments, or to changes in its services, by publishing the updated version on the website. Users are advised to review them periodically.
